Summary

    Credit institutions authorised in Luxembourg

    Pursuant to the principle of mutual recognition of authorisations, credit institutions authorised in Luxembourg are allowed to carry out, in other Member States of the EU or in other States party to the EEA Agreement, any or all of the activities referred to in the list of activities subject to mutual recognition after having completed the following notification procedures:

    • Notification under the freedom of establishment
      •  by establishing a branch in another Member State of the EU or in another State party to the EEA Agreement, or
      • by using a tied agent established in another Member State of the EU or in another State party to the EEA Agreement ;
    • Notification under the freedom to provide services in another Member State of the EU or in another State party to the EEA Agreement.

    The relevant notification forms shall be filed via the IMAS Portal which is a digital gateway launched by the ECB and the national competent authorities for initiating authorisation processes. For further information, please refer to Circular CSSF 23/834.

    Changes to initial notifications, as well as the termination of cross-border activities, have also to be filed via the IMAS Portal.

    Credit institutions authorised in the EU/EEA

    Credit institutions authorised in the EU/EEA that intend to exercise their activities in Luxembourg under the freedom of establishment or under the freedom to provide services are required to complete the necessary formalities with their Home State authority which will notify the CSSF. The same holds true for changes to the initial notification.
